Creating A Paper Trail 101
Many of you have followed the saga of the citizens of Rockland County, who have discovered what we have long known: The FAA lies, cheats, obfuscates, denies, spins, threatens, and generally behaves like a tweener mall rat caught with stolen lip gloss in her waistband. "It wasn't me, it isn't mine, I didn't do it. When do we eat?" They can also act suspiciously like the jailers in "Cool Hand Luke," bellowing and threatening and insuring that their underlings "shaken the tree here, boss" every time they want to take a whiz.
This blog often writes itself and again today that is the case. Read this nugget, and realize you are not alone in your absolute contempt for the Brucecicles and Ventricles and Sissy Joesicles and the rest of the sad sacks of crap that mascarade as leaders of our nation's air traffic system. I'd even go so far as to say that you can put Mr. Tormey in the "non-bridge-building" category. The evidence is clear: the number of people who are rising up to fight the Failed Aviation Administration is multiplying every single day, and will continue to do so until we either win the damn war outright, or storm the walls and overthrow the miserable cretins.

Dear Dr. Taylor:
This letter is in response to your September 17, 2007 letter to me (a copy of which is annexed hereto as Exhibit “A”), regarding the above-referenced FOIA request and Appeal:
1. The fee waiver should be granted, and I expect to seek judicial relief to compel same if you and your FAA colleagues continue to deny it to me.
2. The expedited processing should be granted, and I expect to seek judicial relief to compel same if you and your FAA colleagues continue to deny it to me.
3. Your September 17, 2007 letter is flat wrong. My September 4, 2007 FOIA appeal did appeal the fact that I was denied a fee waiver by Mr. Murphy’s arbitrary, capricious, wrongful and unlawful response. You clearly need to re-read my September 4, 2007 FOIA appeal. If you continue to refuse to do so, I know that a federal judge will not miss what you studiously and to date misread.
4. My September 4, 2007 FOIA appeal did in fact appeal the fact that I was denied expedited processing by Mr. Murphy’s arbitrary, capricious, wrongful and unlawful response. Again, you clearly need to re-read my September 4, 2007 FOIA appeal. If you continue to refuse to do so, I know that a federal judge will not miss what you studiously and to date misread.
5. Your “understanding” that “on August 22, 2007 Mr. Murphy sent [me] two letters” is just nonsensical and false. Perhaps Mr. Murphy lied to you, just like he lied to me in his reply on FOIA and Appeal #2007-006552(ES), among other occasions. The fact is, Mr. Murphy never sent me the “corrected copy” second letter that you claim he sent me. I never received such a response from him or his office on #2007-006536(ES). Rather, the first time I saw the so-called “corrected copy” second letter, is when I saw it enclosed in your September 17, 2007 letter that you sent me. (Exhibit B).
6. What obviously happened is that when Mr. Murphy, and perhaps you, realized just how false and awful Murphy’s “first” August 22, 2007 letter was, some one (or more) parties at the FAA then concocted and back-dated, to August 22, 2007, a letter allegedly signed by a “Pearlis E. Johnson”. I never previously received a copy of a letter signed by a “Pearlis E. Johnson”, and I have no idea who she is. Mr. Murphy’s, your, and the FAA’s “excuse” for what happened - your personal apology notwithstanding - reads like the schoolchild who tells his teacher in the morning that his dog ate his homework. Maybe Mr. Murphy should feed his dog better.
6. I wanted to believe that the presence of a Ph.D. like yourself on this matter might bring it to a smarter conclusion. But the only doctoring I am now seeing, is the doctoring that the FAA engages in when creating falsified and back-dated documents, and the FAA’s continued lies to me and all the 285,000-plus people of Rockland County, New York. That’s a disgrace and its disgusting.
7. Your September 17, 2007 letter indicates: “We [presumably, a ‘Royal We’ reference to you and the FAA] plan no further action on your appeal” [#2007-006536(ES)]. That’s perfect. What that means is that you and the FAA are withdrawing your further opposition to and refusal to fulfill my FOIA request, and withdrawing your further opposition to my FOIA appeal #2007-006536(ES). I am expecting documents from you and your heretofore-concealing colleagues like Mr. Murphy, Doctor Taylor - and I am expecting those documents for free, and immediately. You and Mr. Murphy can save the “My dog ate my homework” excuses for someone more forgiving and more naive. Stop the lies - NOW.

Too bad they just raised the cost of a stamp. Hopefully Rockland County is rich and has deep pockets. It'll be interesting to see how Lyin' Laura Brown, of "no one's ever been denied leave beacuse of staffing" fame, will spin this. They just might have to bring in the heavy-weight liars for this one. Or maybe everyone will get transferred real quick and then they can say we've fixed the problem, see it was the previous regime that did all that nastiness. It's always worked for them before. When will the press and Congress stop taking the FFA at its word?

The writer mentioned a "Pearlis E. Johnson" as someone who'd signed a memo but whose identity the writer didn't know. Turns out Pearlis in 2004 and 2005 was the head of FAA's Africa Division. I personally didn't know they had an Africa Division. Wonder whether it's business casual there too.
Zabasearch.com has exactly one Pearlis E. Johnson in their entire US database. So the writer can be fairly confident that while the memo may well have been back-dated and concocted, there really is a Pearlis E. Johnson.

I don’t see why this attorney will have any more success in dealing with the FAA than any of ours. I am sure our attorneys are just as able to copy the phone directory as this person. If he is more successful than our people at dealing with the government, then perhaps we should try and retain his services.
What seems striking is his obvious passion for the fact he was lied to as have so many employees and/or their representatives. If he doesn’t get anywhere with this letter perhaps he could try building a bridge to the people that are important enough to make changes to the flight paths. Or he could become an airline executive and take control of the FAA.

This guy will get a LOT more done in a shorter time than NATCA does because he believes (as I do) in the 'scorched earth' policy. He feels he and his client have been lied to and disrespected (probably true) and he's pissed. So he sends out a massive shotgun-approach mail campaign which will NOT go unnoticed by the FAA.
Anyone doing something wrong and clandestine fears exposure. While NATCA works the political angle, we're not as brutal in trying to expose the FAA. This lawyer has NO qualms about screaming at the top of his lungs....NATCA would rather talk quietly but forcefully. The former has more fallout damage associated with it, but it's initally more effective.
LONG TERM, though, it's not the best strategy. I think NATCA is taking the proper LONG TERM approach. This guy wants results for his people NOW, and I'm betting he'll get it. But he'll make a LOT of enemys getting what he wants.
If I ever meet the guy, I'll buy him a drink. And THAT'S saying something because I hate lawyers as a rule. ;)

And the problem with this is, what? I think it should be obvious by now that the Bush-Cheney political machine IS an enemy. We invade a foreign country, kill tens of thousands of their citizens, then we start threatening invading other countries. So we can get what we want? It seems like the standard modus oporanda these days.
Hasn't the ATC endured enough "shock and awe" for the last year and a half? Haven't enough fine young people been seriously harmed after being promised the world? Haven't enough people retired early, got sick, resigned, died?
NATCA is afraid to make enemies because...........?

Anybody been watching the blog noise about the NASA "Secret" air safety survey? That may do more than anything to expose all the rampant internal FAA problems. In the 2007 Federal Employee Attitude and Morale survey our sister agency NASA(National Aeronautics and Space Administration) was rated 4th out of 222 Government agencies
NASA got an A
The FAA(Federal Aviation Administration) was rated 204 out of 222. The FAA got an F-minus
I feel more comfortable with NASA dealing with Air Safety than the FAA. It appears according to the survey data the FAA can't find it's butt with both hands.

You don't have to worry about the FAA. They do the right thing even if nobody is watching. If by chance someone in management has made some sort of simple oversite, it will be corrected promptly because there is accountability at all levels.

The FAA I know 'Does the wrong thing even if Everyone's watching'. It's amazing how the Federal AVIATION runs over anyone in it's way like a runaway train! As I posted on the quiet rockland web site blog, too often, we never enter a fight unless the fight is brought to our neighborhood, ie., the Nontract, rerouting airspace, etc. Collectively, the FAA can be beat, but only collectively. That would include congressmen whether or not their district is about to lie under the thoroughfare of aircraft congregating at the nearbye airport, citizens that want highly paid, trained, motivated, rested controllers, media that actually think for themselves instead of reading PR news releases from the FAA, professionals and nonprofessionals alike who aren't afraid to stand up to a disfunctional govt agency that wastes billions of taxpayer dollars for programs that are ALWAYS ontime and under budget. The fight is for all, not for one union, group of citizens, or law firm.
